- Keeping login credentials and passwords confidential.
- Controlling all activity that occurs under their account.
- Notifying TOPTOUR immediately upon discovering any unauthorised access or security risk.
- Keeping account information current and accurate.
TOPTOUR reserves the right to suspend, restrict, or terminate an account if signs of fraud, misrepresentation, or breach of these Terms are detected, or if required by a competent authority.
5. Nature of the Check Visa Service
The Check Visa service is purely for reference and support purposes. It is intended to give users an additional perspective on their application's readiness at the time of assessment. Results may be generated on the basis of business rules, declared data, analytical models, or AI-assisted evaluation tools.
Users understand and agree that:
- Check Visa results do not constitute a legal determination.
- Results are not a guarantee of visa approval.
- Results depend significantly on the accuracy and completeness of the information provided by the user.
- Visa policies of individual countries may change at any time and are beyond TOPTOUR's control.
6. Visa and E-visa Support Services
TOPTOUR may assist users with consultation, information review, application preparation guidance, submission support, or progress tracking within the scope of work communicated or agreed upon.
Users are responsible for:
- Carefully reviewing all information before confirming submission.
- Ensuring that documents, photographs, translations, and declared data are valid and accurate.
- Cooperating by providing information, supplying additional documents, and responding within a reasonable timeframe.
- Complying with entry, exit, residency, and other requirements of competent authorities.
TOPTOUR is not liable for consequences arising from incorrect declarations, submission of invalid documents, incomplete information, or failure to follow provided instructions.
7. Visa Decisions and Processing Times
All decisions regarding the grant, refusal, cancellation, amendment, or limitation of a visa are within the exclusive authority of the competent issuing body. TOPTOUR does not guarantee that an application will be approved, even where consultation or technical assistance has been provided.
Any processing times displayed or communicated are estimates only. Actual times may vary due to review procedures, application volumes, public holidays, requests for additional information, technical issues, or other objective factors.
8. Fees, Payment, and Refunds
Users agree to pay in full all fees associated with the services at the rates published, quoted, or displayed by TOPTOUR at the relevant time.
General principles:
- Service fees may be separate from government levies, visa fees, bank charges, currency conversion fees, or third-party fees.
- Certain fees may be required before TOPTOUR begins processing a request.
- Once an application has been received, in-depth consultation has been carried out, documents have been reviewed, or an application has been submitted or pushed to a relevant system, fees already paid may be non-refundable.
- Refusal of an application by a competent authority does not automatically give rise to a refund obligation on TOPTOUR's part.
- For government levies or fees paid through an E-visa processing portal, refundability is subject to the rules of the receiving authority or entity and in many cases will not be refunded.
Where TOPTOUR has a specific refund policy for a particular service package, that policy will take precedence for the corresponding package.
9. Third-Party Services and Platforms
The TOPTOUR website or services may integrate with or link to third-party providers such as payment gateways, infrastructure providers, email platforms, analytics tools, official application systems, or government websites.
TOPTOUR is not responsible for:
- The content, policies, or conduct of third-party websites.
- Interruptions, technical errors, or policy changes on the part of third parties.
- Losses arising from users transacting directly with third parties outside TOPTOUR's reasonable control.
10. Intellectual Property
All content on the website, including but not limited to the interface, layout, text, images, icons, logos, data, source code, editorial content, guidance materials, and brand identity elements, is owned by or licensed to TOPTOUR or its licensors.
Users may not copy, modify, distribute, republish, commercially exploit, or otherwise make unauthorised use of any website content without prior written consent from TOPTOUR, except as permitted by applicable law.

- Failure by a user to make timely payment or to cooperate by providing required information.
- A requirement from a competent authority.
- System maintenance, upgrades, or objective technical incidents.
Suspension or termination in the above circumstances does not give rise to a liability for compensation on TOPTOUR's part, unless otherwise required by law.
13. Limitation of Liability
To the fullest extent permitted by law, TOPTOUR is not liable for:
- Refusals, delays in processing, changes to conditions, or cancellations of visas by a competent authority.
- Losses arising from inaccurate or incomplete information provided by the user.
- Indirect, incidental, or consequential damages, including loss of opportunity, loss of revenue, or losses arising from events outside TOPTOUR's reasonable control.
- Service interruptions caused by network failures, third-party errors, force majeure, natural disasters, epidemics, policy changes, or infrastructure incidents.
Where direct liability on TOPTOUR's part is established, the aggregate maximum liability of TOPTOUR in respect of any single claim shall not exceed the amount of service fees actually paid by the user for the specific service in question, unless otherwise mandated by applicable law.

16. Personal Data
The collection and processing of personal data in the course of using the website and services is carried out in accordance with TOPTOUR's Privacy Policy. By using the services, users consent to the processing of their data as described in the Privacy Policy as updated from time to time.
17. Amendment of Terms
TOPTOUR reserves the right to update, amend, or supplement these Terms of Service at any time to reflect changes in the services, systems, or legal requirements. Updated versions will be published on the website and shall take effect from the date of publication unless otherwise stated.
